How “G0Daddy” deceived its customer, took a domain from the portfolio and sold it to a hush buyer!

Mahendra graduated in 2007 with a Master of Science in Internetworking from the University of Technology Sydney (UTS). After graduation, I came up with the business idea to store computer files and documents stored in the cloud. Therefore, on Monday, the 1st day of December 2008, at 11:49, Mahendra registered a domain name www.CloudBackup.com.au under Mahendra’s company named “INFO 77 Pty Ltd”.

Mahendra was running some internal on and off services using this domain. Later in 2014, Mahendra transferred this domain to GoDaddy.com Registrar ( Domain Registry) from SmartyHost.com.au.

Mahendra has regularly been paying its annual renewal fee for two years to GoDaddy Inc ( Also have an Australian presence).

The most recent renewal fee Mahendra had paid on Nov 19 2018. Therefore, domain www.CloudBackup.com.au was for my company (INFO 77 Pty Ltd) is fully paid (Invoice/Order# 1399900805) for its registration fee until November 2020.

On Apr 18 2019, Mahendra received an email (the 9th day of April 2019, 1:58 AM) from domain name registry “GoDaddy.”

the email reads as follows (the 18th day of April 2019, 12:25 AM):

“We’ve been notified by .AU Domain Administration (auDA) that cloudbackup.com.au is in breach of policy. We’re sorry, but this violation means that the domain will be deleted.

The relevant rules on .AU domain eligibility can be found at auda.org.AU/policies/2012–04/

We’d be happy to present that information to auDA on your behalf. Simply reply to this email and we’ll initiate the process. “

Unfortunately, Mahendra’s mother was fighting breast cancer. Mahendra lost his father to a heart attack in 2012, and ever since, Mahendra was busy taking care of his mother’s cancer treatment. Unfortunately, Mahendra lost his mother to cancer in 2019.

Due to family circumstances and other family responsibilities, Mahendra missed that email from GoDaddy and could not reply within the two-week timeframe they gave in that email.

However, Mahendra never received a final warning email.

Mahendra also never received any phone call in this regard, while Mahendra had received 100s of calls regularly for sale / up-sale from GoDaddy. So, therefore, GoDaddy does have Mahendra’s working mobile number in their records.

On my next login to my portfolio in May 2019, Mahendra noticed that email and replied (the 17th day of May 2019, 10:27 PM) to GoDaddy asking for the following (Mahendra wrote):

Hello there “GoDaddy,”

Sorry about the delay in response as there is a medical emergency in the family. My mother is fighting breast cancer, and her well-being care is my priority.

Could you please send me a copy of the complaint made against this domain in question and the description of the alleged nature of the breach it may have caused, as I am aware that there has been no breach at all?

This domain in my copyright has been internally used for backup(s). One of those uses but is not limited to is our company email-backup(s) in the cloud using Google Business emails, and the evidence of those could be presented before the court if required.

Since then, the domain was deleted from my portfolio and registered to another company which makes is sold twice under the same period while still paid by me/company.

I have also written to “AuDa” (.Au Domain Administration Ltd) and have not received any satisfactory response at all.

GoDaddy and “AuDa”, both companies and or organizations, are ignoring my request to give my domain back to me as I still pay it until November 2020.

I have asked the following question to both “GoDaddy” and “AuDa.”

Till today Mahendra hasn’t received any response from you. Therefore, this is his public post asking for details. (Tens of more sent and got no response ever since)

Mahendra Singh (Director of INFO 77 Pty Ltd) need to know the answers to the following questions:

1 — What contractual clause was breached?

2 — When has the actual breach occurred?

3 — On who’ behalf, this Incident ID [Incident ID: 38777485] was reported and by whom?

4 — How did you conclude that my company and I are guilty before proving myself and my company (INFO 77 Pty Ltd) innocent?

For legal, I need to cite the original incident report.

Would you please provide me with the answers to the questions mentioned earlier?

I am not getting any response whatsoever from GoDaddy and also no reaction from “AuDa.”

Feel free to speak your mind, as I do need your help with getting to the bottom of this saga and exposing this supposed fraud.

P.S. I lost my mother to breast cancer on Sept 14 2019.

Note: Since Nov 14, 2019, there is no response whatsoever to my tens of email(s) to AuDa. ACCC & Department of Communications and the Arts both are bouncing the ball around.
